End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and OffByThree LLC ("Company", "we", "us", or "our") for the use of DediForge software ("Software").

BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.

1. License Grant

Subject to the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the Software on devices you own or control
  • Use the Software for personal or commercial server hosting purposes
  • Create backups of the Software for archival purposes

2. Restrictions

You may NOT:

  • Reverse engineer, decompile, or disassemble the Software, except where permitted by law
  • Remove or alter any proprietary notices, labels, or marks on the Software
  • Use the Software to violate any applicable laws or regulations
  • Redistribute, sell, lease, or sublicense the Software
  • Use the Software to host servers that violate game publishers' terms of service
  • Use the Software for any illegal activity, including but not limited to hosting servers for pirated games

3. Third-Party Software

3.1 Game Server Software

The Software facilitates downloading and managing game server software from official sources (primarily via SteamCMD). This third-party software is subject to its own license agreements:

  • Game server software is provided by game publishers under their respective licenses
  • You must comply with each game's End User License Agreement and Terms of Service
  • We do not provide, modify, or distribute game server executables

3.2 SteamCMD

The Software uses SteamCMD, provided by Valve Corporation, to download game server files. Your use of SteamCMD is subject to Valve's terms of service.

3.3 Open Source Components

The Software includes open source components licensed under various open source licenses. A complete list of these components and their licenses is available in the Software's "Third-Party Licenses" section.

4. Intellectual Property

4.1 Ownership

The Software, excluding third-party components, is owned by OffByThree LLC and is protected by copyright and other intellectual property laws.

4.2 Trademarks

All game titles, logos, and related marks displayed in the Software are trademarks of their respective owners. Their use is for identification purposes only and does not imply affiliation or endorsement.

5. Network and Security

5.1 Port Forwarding

The Software may configure port forwarding on your router using UPnP. You are responsible for:

  • Understanding the security implications of opening network ports
  • Configuring appropriate firewall rules
  • Securing your network infrastructure

5.2 No Warranty of Security

We do not guarantee that servers hosted using the Software will be secure from attacks, exploits, or unauthorized access.

6. Data Collection

6.1 Local Data

The Software stores configuration data locally on your device. This includes:

  • Server configurations and settings
  • Game server logs
  • Application preferences

6.2 No Telemetry

The Software does not collect, transmit, or share any personal data, usage statistics, or telemetry with us or third parties, except as explicitly stated in our Privacy Policy.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

  • The Software will meet your requirements
  • The Software will be uninterrupted, timely, secure, or error-free
  • Game servers will function correctly with all games
  • Third-party game servers will be compatible with future game updates

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFBYTHREE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Server downtime or data loss
  • Network security breaches
  • Damage to hardware or other software
  • Any damages arising from your use of third-party game server software

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

9. Indemnification

You agree to indemnify and hold harmless OffByThree LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Software
  • Your violation of this Agreement
  • Your violation of any third-party rights
  • Servers you host using the Software

10. Termination

10.1 Termination by User

You may terminate this Agreement at any time by uninstalling and destroying all copies of the Software.

10.2 Termination by Company

We may terminate this Agreement if you breach any term. Upon termination, you must cease all use of the Software and destroy all copies.

10.3 Survival

Sections 7, 8, 9, and 11 shall survive termination of this Agreement.

11. General Provisions

11.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Entire Agreement

This Agreement constitutes the entire agreement between you and OffByThree LLC regarding the Software and supersedes all prior agreements and understandings.

11.3 Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

11.4 Waiver

Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

11.5 Updates to Agreement

We reserve the right to modify this Agreement at any time. Continued use of the Software after changes constitutes acceptance of the modified Agreement.
